The basics
These terms are an agreement between you and True Momentum Marketing LLC ("True Momentum", "we", "us"). They apply when you use truemomentumusa.com and when you order services from us. Placing an order or creating an account means you accept them. If you're ordering on behalf of a business, you confirm you're authorised to do so.
Ordering and quotes
Every service on this site has a published price. When you place an order, we send a quote by email confirming the services, plans and total. Your order is confirmed when payment for the first period clears. If anything in your intake changes the scope, we'll tell you before starting and won't charge more without your agreement.
Payment
- Ongoing services are billed monthly in advance, from the date your order is confirmed.
- One-time projects such as websites, landing pages, creative packs and setup fees are billed as quoted, in advance.
- Advertising spend is paid by you directly to the advertising platform and is separate from our management fee.
- We accept Zelle and, where available, card payments. Late payment may pause work until the account is brought current.
No long-term commitment
Ongoing services are month-to-month. You can cancel at any time by emailing us; cancellation takes effect at the end of the current billing period and you keep everything delivered up to that point. Refund terms are in our Refund Policy.
What we need from you
- Accurate information in your intake, and timely answers when we have questions.
- Access to the accounts and assets a service needs, such as your website, Business Profile or ad accounts.
- Approval of work within a reasonable time where approval is part of the service. If we don't hear back, we may proceed to keep the schedule.
- The right to use any content, logos, photos or footage you give us.
Our commitments and limits
We'll do the work described in your plan with reasonable skill and care, report to you as promised, and be honest about what's working. Marketing results depend on factors outside anyone's control, including search engine and ad platform changes, competition and your market, so we don't guarantee specific rankings, traffic, leads or revenue. Timelines on the site are typical expectations, not promises.
Ownership
Once paid for, the deliverables we create for you, such as pages, content, creative and reports, are yours. Our internal tools, processes and templates remain ours. Third-party assets such as stock photos, fonts or software are subject to their own licences.
Accounts
Keep your password private and tell us if you think your account has been accessed without permission. You're responsible for activity under your account.
Acceptable use
We don't work on campaigns that are unlawful, deceptive or that violate the policies of the platforms involved. We may decline or end work that would put us or our clients at risk, and we'll refund any unearned fees if we do.
Liability
To the extent the law allows, our total liability for any claim connected with our services is limited to the fees you paid us in the three months before the claim arose, and we're not liable for indirect losses such as lost profits. Nothing in these terms limits liability that cannot be limited by law.
Ending the agreement
Either of us can end an ongoing service at the end of a billing period. We may end it sooner if payment is overdue or these terms are broken. On ending, we'll hand over completed work and remove our access to your accounts on request.
Other terms
These terms are governed by the laws of the State of Texas, and any dispute will be handled in the courts located there. If part of these terms is found unenforceable, the rest still applies. We may update these terms; the date at the top shows the current version, and continued use after a change means you accept it.
